Serious Charges Filed Against MLA Rahul Mamkootathil for Assault in Thiruvananthapuram and Palakkad Flats

Thiruvananthapuram: MLA Rahul Mamkootathil is facing severe non-bailable charges, carrying penalties ranging from 10 years to life imprisonment, following a complaint of sexual assault filed by a woman. Authorities are moving to swiftly arrest the MLA, and a lookout notice has been issued to prevent him from leaving the country, as it is believed he may have already departed Kerala.

The charges against Mamkootathil include sections from the Bharatiya Nyaya Sanhita (BNS) such as BNS 64 (rape), BNS 89 (forced abortion), BNS 116 (causing bodily harm), BNS 316 (breach of trust), BNS 329 (house trespass), and BNS 351 (threatening). Additionally, Section 66C of the Information Technology (IT) Act, pertaining to threatening over the phone, has also been invoked.

The case, initially registered by Valiyamala police based on the woman’s complaint, has been transferred to Nemom station for further investigation. Police investigations suggest that the alleged crimes occurred in three different locations. The first incident of assault reportedly took place in March. The woman claims she was assaulted twice at her flat in Thiruvananthapuram and once at Rahul Mamkootathil’s flat in Palakkad.

Further disturbing details from the First Information Report (FIR) indicate that the victim was coerced into an abortion on May 30. Medicine for the abortion was allegedly provided by Rahul’s friend, Joby, and administered in a car. Rahul then reportedly confirmed the consumption of the medicine via a video call. The FIR also includes allegations that Mamkootathil threatened the woman with her nude visuals captured after the assault.

Here are the specific charges levied against Rahul Mamkootathil in the FIR:

* **BNS 64 (Rape):** Punishable by a minimum of 10 years imprisonment, extending up to life imprisonment, and allows for arrest without a warrant.
* **BNS 89 (Forced Abortion):** Carries a sentence of 10 years to life imprisonment.
* **BNS 316 (Breach of Trust):** Punishable by up to 5 years imprisonment and a fine.
* **BNS 116 (Causing Bodily Harm):** Carries a sentence of up to 7 years imprisonment and a fine.
* **BNS 329 (House Trespass):** Punishable by one year imprisonment and a fine of Rs 5000.
* **BNS 351 (Threatening):** Carries a sentence of up to 2 years imprisonment and a fine.
* **IT Act 66C (Threatening over Phone):** Punishable by up to 3 years imprisonment and a fine of Rs 1 lakh.
