Rahul Mamkootathil Files Anticipatory Bail Application in Second Rape Case

Thiruvananthapuram: Youth Congress leader Rahul Mamkootathil has filed an anticipatory bail application in a second case, immediately after the Kerala High Court stayed his arrest in connection with the first rape complaint. The latest application was submitted to the Thiruvananthapuram Principal Sessions Court, which is scheduled to hear the petition today, December 6, 2025.

The second complaint was lodged by a 23-year-old woman from Bengaluru. Mamkootathil’s move to file a new petition comes amidst the absence of any stay on his arrest in this second case.

Earlier, Justice K. Babu of the High Court had issued an order granting Mamkootathil interim protection from arrest in the first complaint until the case is taken up for further consideration. This particular case has been adjourned to December 15. Mamkootathil had approached the High Court after the Thiruvananthapuram Sessions Court rejected his initial anticipatory bail application on December 4.

The first anticipatory bail application was filed following a direct complaint submitted by the woman and her family to Chief Minister Pinarayi Vijayan on November 27. The MLA has been accused of grave charges including rape, pregnancy resulting from sexual assault, and forced abortion. The complainant also alleged that Mamkootathil video-recorded private moments and used them to threaten her.

A case has been registered against Mamkootathil under various sections of the Bharatiya Nyaya Sanhita (BNS). These include Section 64 for rape, Section 89 for forced abortion, Section 316 for criminal breach of trust, Section 351 for criminal intimidation, Section 329 for trespassing, and Section 116 for grievous hurt. Additionally, he has been booked under Section 66E of the Information Technology Act for violating privacy.

In his anticipatory bail plea concerning the first case, Mamkootathil admitted to having a physical relationship with the complainant but strongly contended that the relationship was entirely consensual.
